Last year, Helene, a woman from Sierra Leone, and her family were attacked with machetes, burned, and sexually assaulted by rebels from the Revolutionary United Front. The rebels killed one of her family members, attacked her son, and held her captive for four days repeatedly raping her and her daughter. The rebels forced Helene to wash clothes for them and cook meals. Helene is now barred from seeking refugee or asylum protection in the U.S. because she cooked and cleaned for the rebels while she was held captive (New York Times – April 3, 2006).

Because of an unintended interpretation of the USA Patriot Act, Helene and thousands of other victims of terrorism just like her are unable to get the protection they need. The USA Patriot Act amended our immigration laws to prevent terrorists and their supporters from coming to the United States. While the goal of stopping terrorists is vital, these amendments now have the effect of denying protection to victims of terrorism who have legitimate and deserving claims to seek asylum in the United States.

Victims of terrorism who were forced under threat of death or serious bodily injury into providing food or shelter to terrorist groups are now defined as having provided “material support” to terrorists. And because of that, they are ineligible for resettlement in the United States according to the Patriot Act.

Changes to these laws would help ensure that victims of terrorism can get the protection they need in the United States, without weakening the anti-terrorism 
provisions of U.S. immigration law or compromising U.S. security interests. The new Congress is considering legislation to amend these unfair provisions right now, and with your help we can seize this opportunity to make sure that the refugee victims of terrorism are not left out in the cold.

El año pasado, Helene, una mujer de Sierra Leona, y su familia fue atacada con machetes, fueron quemados, y sexualmente asaltados por rebeldes del Revolucionario el Frente Unido. Los rebeldes mataron a uno de sus miembros de familia, atacó a su hijo, y la sostuvieron cautiva durante cuatro días, donde repetidamente fue violada ella y su hija. Los rebeldes forzaron a Helene a lavar a la ropa para ellos y hacer comidas de cocinera. Helene ahora es excluida de ser refugiada o la protección de asilo en EE UU porque ella cocinó y limpió para los rebeldes mientras ella fue sostenida en el cautivo (New York Times - el 3 de abril de 2006).

Las historias como ésta se hacen lejanas demasiado comunes entre los refugiados a los cuales el Comité fue establecido para ayudar. A causa de una interpretación no
planeada del Acto de Patriota estadounidense, Helene y miles de otras víctimas de terrorismo justo como ella son incapaces de conseguir la protección que ellos necesitan. Con su ayuda, podemos cambiar esto.

El Acto de Patriota estadounidense enmendó nuestras leyes de inmigración para prevenir a terroristas y sus partidarios de venir a los Estados Unidos. Mientras el objetivo de terroristas paradores es vital, estas enmiendas ahora tienen el efecto de negar la protección a las víctimas de terrorismo que tienen reclamaciones legítimas y que merecen de pedir asilo en los Estados Unidos.

Las víctimas de terrorismo a que forzaron bajo la amenaza de daños corporales de muerte o serios en el suministro del alimento o el refugio a grupos terroristas ahora son definidas como habiendo proporcionado " el apoyo material " a terroristas. Y debido a esto, ellos son inelegibles para el restablecimiento en los Estados Unidos según el Acto de Patriota.

Si se cambian estas leyes ayudaría a asegurar que las víctimas de terrorismo pueden conseguir la protección ellos necesitan en los Estados Unidos, sin debilitar las provisiones de antiterrorismo de ley de inmigración estadounidense o comprometer intereses de seguridad(valor) estadounidenses. El nuevo Congreso considera la legislación para enmendar estas provisiones injustas ahora mismo, y con su ayuda podemos agarrar esta oportunidad de asegurarse que las víctimas de refugiado de terrorismo no son excluidas en el frío.
